Terms of Service

§ 1 Validity

(1) The General Terms and Conditions (GTC) are part of the contracts concluded between the customer and proud2craft GmbH, Schnewlinstraße 12, 79098 Freiburg (hereinafter referred to as “seller”), which come about via the seller’s website. Deviating conditions of the customer are not recognized unless the seller expressly agrees to their validity in writing.

(2) Customers within the meaning of these General Terms and Conditions are both consumers and entrepreneurs.

§ 2 Conclusion of contract

(1) The contract is concluded as follows via the website, unless the alternative described under Section 2 applies: The customer can initially place the products in the shopping cart without obligation and correct his entries before sending his binding order by using the Uses the correction aids provided and explained in the order process. By clicking on the order button that concludes the ordering process, the customer places a binding order for the goods contained in the shopping cart. The confirmation of the receipt of the order takes place immediately after sending. The seller can accept the offer by asking the customer • a written order confirmation or an order confirmation in text form (e-mail), whereby the receipt of the order confirmation by the customer is decisive, • delivers the ordered goods, in which case receipt by the customer is decisive, • requests payment after placing his order. A request for payment also occurs when the customer is given bank details, asked to enter credit card details or the customer is forwarded to a payment service provider. If there are several of the above alternatives, the contract is concluded at the point in time at which one of the above alternatives for acceptance occurs first.

(2) Contrary to Section 1, the following applies: If the customer uses an instant payment system (e.g. PayPal, PayPal Plus) as a payment method that is integrated into the seller's ordering process, the customer will be redirected to the website of the provider of the instant payment system. If the forwarding to the respective instant payment system takes place, the customer makes the appropriate selection or enters his data there. The contract offered by the seller is then concluded with the customer's payment order through the instant payment system. Before receiving instructions, the customer has the opportunity to check all the information again, to change it (also using the "back" function of the internet browser) or to cancel the purchase.

(3) The text of the contract is saved by the seller and is sent to the customer along with it Terms and Conditions sent.

§ 3 Prices, payment, delivery

(1) The prices given are final prices, i.e. including the statutory value-added tax and plus the delivery and shipping costs, unless free shipping is available.

(2) The payment options are limited to payment via PayPal Plus, PayPal, purchase on account via PayPal, credit card via PayPal, direct debit via PayPal and Amazon Pay. If other options are offered, this results from the descriptions on our website.

(3) If the customer is an entrepreneur, the following applies: Regardless of whether the delivery is made by the seller, the customer or a third party, the risk is transferred to the customer as soon as loading begins or the customer is no longer obliged to accept the goods Goods not coming.

(4) The delivery time information can be found in the product descriptions. Unless otherwise stated, the delivery time is 5-7 working days.

§ 4 Cancellation policy for consumers

Consumers are entitled to a right of withdrawal in accordance with the following instructions, whereby a consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed.

Right of withdrawal


You have the right to withdraw from this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the goods. You can use the attached sample revocation form for this, but this is not mandatory. To meet the cancellation deadline, it is sufficient for you to send the communication regarding your exercise of the right of cancellation before the cancellation period has expired.

Consequences of revocation
If you revoke this contract, we have paid you all payments that we have received from you, including delivery costs (except for the additional costs resulting from the fact that you have chosen a different type of delivery than the cheap standard delivery offered by us have), immediately and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged fees for this repayment. We may refuse repayment until we have received the returned goods or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods to us immediately and in any event no later than fourteen days from the day on which you inform us of the cancellation of this contract. The deadline is met if you send back the goods before the period of fourteen days has expired. You bear the direct costs of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

§ 5 Warranty

The statutory provisions apply to the rights of the customer in the event of defects in quality and title.

§ 6 Liability

(1) Liability is excluded for damage to legal interests other than life, body or health, unless the damage is due to intentional or grossly negligent behavior on the part of the seller, one of his legal representatives or one of his vicarious agents and the behavior there is also no violation of essential contractual obligations. Significant contractual obligations are those obligations the fulfillment of which is essential for the proper execution of the contract and on the observance of which the customer can regularly rely.
(2) This exclusion of liability does not apply insofar as claims under the Product Liability Act are concerned, a defect has been fraudulently concealed or a quality guarantee has been assumed.

§ 7 Retention of title

The goods remain the property of the seller until full payment has been made.

§ 8 Final Provisions

(1) The relationships between the contracting parties are governed by the law applicable in the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). This choice of law applies to a consumer only insofar as it does not restrict any mandatory statutory provisions of the state in which he has his place of residence or habitual abode.
(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is the registered office of the seller. The same applies if the customer does not have a general place of jurisdiction in Germany or if his domicile or habitual abode is not known at the time the action is filed.
(3) The contract language is German.
